The Supreme Court case that could ban life-saving, emergency abortion care

The U.S. Supreme Court is hearing oral arguments on April 24, 2024, to determine if states can deny pregnant people emergency medical care.

We have this right because of the Emergency Medical Treatment and Labor Act (EMTALA), a federal law that has been around for nearly 40 years. It has always covered emergency abortion care, but now anti-abortion extremists are saying that they’d rather let pregnant people suffer than be provided with life-saving care.

It’s easy for politicians and talking heads to get into the weeds of the law and the judicial system, so instead we want to talk about the reality of these draconian bans.

What does it mean to be denied life-saving abortion care?

Unfortunately, horror stories from across the country have already shown us how devastating state abortion bans are. If SCOTUS rules in favor of states being able to deny emergency abortion care, things will only get worse—no matter where you live.

We should not have to wait until experiencing the most severe, painful, and life-threatening complications until a doctor can step in to provide treatment.

We should not have to wonder whether a physician will be able to provide standard pregnancy care.

Patients and doctors should not have to fear criminal repercussions for seeking or providing abortion care.

This is what we’re fighting for. Access to health care in emergency situations. Trust that physicians can put our care first. The right to make decisions about our own bodies.
