Reproductive Freedom for All Calls for Investigation into Justice Alito’s Conduct and Recusal

Washington, DC Today, Reproductive Freedom for All called upon the Senate Judiciary Committee to investigate Justice Samuel Alito’s conduct after recent reporting revealed that he waved a January 6th insurrection symbol outside his home while the Supreme Court was considering whether to hear a case contesting the validity of the 2020 presidential election. On Friday, Chair Durbin called for Justice Alito’s recusal from all Supreme Court cases related to the election.

Reproductive Freedom for All President and CEO Mini Timmaraju released the following statement:

“From Justice Alito’s long list of ethical scandals to these recent revelations about his behavior following the days of the January 6th insurrection, it’s clear that Alito is operating with no accountability and zero concern for the integrity of our nation’s highest Court. The Supreme Court will soon release decisions on two major abortion cases, and an investigation into Alito’s actions will help determine whether Alito and his allies on the Court are prioritizing special interests over the rights of the people. The time to restore faith in the Court is now, and to do so, Justice Alito’s actions must be investigated and he must recuse himself from all cases related to the election.

Justice Alito has put his blatant disregard for Americans’ fundamental rights and freedoms—including reproductive freedom—on display time and again. According to previous reporting from the New York Times Justice Alito shared the outcome of the U.S. Supreme Court’s decision in Burwell v. Hobby Lobby Stores “weeks before it was announced,” allowing an anti-abortion activist “to prepare a public relations push” and tip off the head of the Hobby Lobby chain. The 2014 Hobby Lobby ruling allowed certain bosses to block their employees’ access to birth control. Alito authored the opinion in the case himself, and later authored the opinion overturning Roe v. Wade in Dobbs v. Jackson Women’s Health Organization. Last year, reporting from ProPublica revealed that Alito had also taken a luxury vacation with conservative billionaire Paul Singer, whose “hedge fund came before the court at least 10 times in cases where his role was often covered by the legal press and mainstream media.”
