Reproductive Freedom for All Applauds Arizona Court Decision Striking Down Unconstitutional Abortion Restrictions

Phoenix, AZ — Today, an Arizona state court ruled that several burdensome and medically unnecessary abortion restrictions are unconstitutional under the 2024 voter-approved state protections for reproductive freedom enshrined by the passage of Proposition 139. In a landmark case brought by the Center for Reproductive Rights, the American Civil Liberties Union, and ACLU of Arizona on behalf of abortion providers and the Arizona Medical Association, the court permanently blocked the state’s 24-hour waiting period and biased counseling requirement, reason ban, and telemedicine ban.

Reproductive Freedom for All Director of Arizona Campaigns Athena Salman released the following statement:

“This is a huge victory in the fight to ensure all Arizonans can get the care they need without delay or political interference. We are grateful to our partners and the providers who brought this case and to Attorney General Mayes who fought alongside the plaintiffs to defend our constitutional rights.

This ruling was made possible by the Arizonans who overwhelmingly voted to pass Proposition 139. The right to abortion is hollow without meaningful access, and today’s victory makes clear that constitutional protections cannot exist in name only.”
