Reproductive Freedom for All on the Supreme Court’s Decision to Temporarily Block Fifth Circuit Ruling Restricting Access to Mifepristone

Washington, DC — This morning, the Supreme Court temporarily restored telehealth, mail, and pharmacy access to mifepristone. This was in response to an emergency appeal of the Fifth Circuit’s Friday ruling that had reinstated medically unnecessary, nationwide in-person dispensing requirements. This administrative stay will temporarily restore access until Monday, May 11th, while the Court reviews the emergency appeals.

Mifepristone is used in nearly two-thirds of abortion care in the United States, and the majority of prescriptions are filled at pharmacies or through the mail. This ruling and the temporary stay impact access to care nationwide, even in states that protect abortion access.

Reproductive Freedom for All President and CEO Mini Timmaraju released the following statement:

Today’s stay gives patients and providers only a brief moment to breathe as the dust settles on the most severe blow to abortion access since Dobbs. We cannot trust this Court to protect abortion access—the same justices who ripped away the federal right to abortion are now deciding whether patients can access the medication that makes up the majority of abortion care in America. Anti-abortion extremists were never going to leave abortion to the states. We will keep fighting until every person has access to the care they need, and organize to hold anti-abortion lawmakers accountable this November.”
