Reproductive Freedom for All Responds to Trump Judge Ruling Allowing Baseless Case Threatening Mifepristone to Proceed

Washington, DC — On Thursday, Trump-appointed Judge Matthew Kacsmaryk ruled that the GOP-led states of Idaho, Missouri, and Kansas can proceed with their case against the U.S. Food and Drug Administration attempting to effectively ban mifepristone, a safe and effective medication used in early abortion and miscarriage care. Kansas and Missouri have both passed ballot measures enshrining reproductive freedom in their state constitutions, making clear that voters in these states support abortion—even in the face of these efforts to block access.

Despite the U.S. Supreme Court already ruling in Alliance for Hippocratic Medicine (AHM) v. FDA that the case didn’t have standing and AHM dropped its lawsuit, this ruling moves the litigation forward. The case’s future will now be determined by Trump’s Department of Justice—with anti-abortion extremist Pam Bondi likely at the head of the agency.

“This case is baseless and the only reason it is proceeding is because a Trump-appointed judge hellbent on banning abortion had another chance to weigh in. With Trump poised to appoint even more judges to the federal judiciary, we must hold him and the Republicans who enable him accountable for the chaos and threats they are waging on our rights.”
