Reproductive Freedom for All Applauds Wisconsin Supreme Court Decision to Strike Down 1800s Total Abortion Ban
Washington, DC — Today, the Wisconsin Supreme Court struck down the state’s 176-year-old total abortion ban. The 4-3 decision today means that the 1849 law is unenforceable, and no longer bans abortion in Wisconsin. Previously, a lower court had blocked the 1849 law, and this law was not being enforced. Today’s decision makes this permanent, marking a major victory for protecting reproductive freedom in Wisconsin.
Reproductive Freedom for All President and CEO Mini Timmaraju released the following statement:
“The Wisconsin Supreme Court’s decision to strike down an archaic abortion ban is a monumental victory for reproductive freedom. Thank you to our reproductive freedom champions, Gov. Evers and AG Kaul, for never backing down from this fight. Reproductive Freedom for All worked alongside Wisconsin organizers to elect a reproductive freedom majority state supreme court because we knew what was at stake two years ago. This decision today is a reflection of the people who have made it clear they want to protect their access to abortion.”
The Wisconsin Supreme Court held an anti-choice majority for years, posing an urgent threat to reproductive freedom statewide. In 2023, Reproductive Freedom for All organized and deployed its members to help get Justice Janet Protasiewicz elected. Judge Janet’s victory marked a shift in the Wisconsin Supreme Court that has proven critical in protecting reproductive freedom in Wisconsin.
