Reproductive Freedom for All Celebrates Pennsylvania Court Striking Down the State’s Ban on Abortion Care Coverage Under Medicaid
Washington, DC — Today, a Pennsylvania court struck down the state’s ban on Medicaid coverage for abortion care. The court ruled that the ban is unconstitutional because reproductive freedom is a fundamental right protected by the Pennsylvania constitution—and because the state’s Medicaid program covers all other reproductive health care, denying care for abortion specifically is unlawful discrimination based on sex.
Approximately 3 million people are covered under Medicaid in the Commonwealth, and this decision ensures they can access the care they need without barriers or political interference. By upholding the protections outlined in the Pennsylvania constitution, the court has affirmed that reproductive autonomy is a constitutional right in the state and established a landmark precedent for other states aiming to defend reproductive freedom in the wake of the Dobbs decision.

“Today’s ruling out of Pennsylvania is a major victory for Pennsylvanians and for reproductive freedom. Coverage bans like these push care even further out of reach for people who already face barriers to getting the care they need. Politicians do not get to decide who gets access to abortion based on income. As anti-abortion extremists work to chip away at Medicaid coverage nationwide and undermine state protections, this is a powerful reminder that our freedom to make personal health care decisions is not up for debate, and that reproductive freedom is a fundamental right.”
