Reproductive Freedom for All Condemns Trump Administration Attack on Emergency Abortion Care

Washington, DC — Today, the Trump administration rescinded the Biden administration’s guidance on the Emergency Medical Treatment and Labor Act (EMTALA), a federal law that ensures patients experiencing medical emergencies receive the care they need, including abortion care. This action rolls back protections for pregnant people who need abortion care, breaking away from decades of precedent.

Since it was signed into law nearly 40 years ago with broad bipartisan support, EMTALA has guaranteed that hospitals must provide stabilizing care to anyone experiencing a medical emergency. This ensures that every patient in need of emergency care can receive the care they need without delay or political interference.

Reproductive Freedom for All President and CEO Mini Timmaraju released the following statement in response:

“Stripping away this guidance means women will die. The Trump administration is clearly refusing to protect pregnant people in crisis. It’s another calculated step in Trump’s war on reproductive freedom—siding with extremists who want to punish doctors and abandon patients. No one should be denied emergency care, and we’ll hold every official who enables this cruelty accountable.”

Ever since the Supreme Court overturned Roe, pregnant patients facing life-and health-threatening emergencies haven’t been guaranteed to get the care they urgently need. Some have even been forced to wait until they are on the brink of death to get treatment. Several women have died in states with bans because they were denied emergency care. Josseli Barnica suffered from miscarriage complications for 40 hours. Nevaeh Crain visited three emergency rooms with complications before she was finally admitted. Amber Thurman was denied treatment for a grave infection.

The overwhelming majority of Americans — nearly 9 in 10 — support protecting access to emergency abortion care.
