Reproductive Freedom for All Highlights Ongoing Mifepristone Attacks After District Court Stalls Florida v. FDA
Washington, DC — Yesterday, a Republican-appointed judge on the U.S. District Court for the Northern District of Texas granted the Food and Drug Administration’s motion to stay Florida v. FDA at the Trump administration’s request, leaving access to mifepristone in jeopardy. The court relied on misinformation to issue a stay rather than follow the science, which for decades has demonstrated mifepristone’s safety and efficacy, and dismiss the case altogether. The motion pauses the case until the FDA completes its politically-motivated “review” of mifepristone or until December 1, 2026—whichever comes first. Florida and Texas, the states that brought the lawsuit, agreed to the court’s pause in the case, delaying further action until after the midterm elections.

“Republican attacks on mifepristone are relentless, and Florida and Texas agreed to pause their lawsuit only because they are betting Trump’s FDA will deliver the national backdoor abortion ban they can’t win in court or at the ballot box. We can’t let that happen. We will hold Republicans accountable for their anti-abortion extremism this November.”
Florida Attorney General James Uthmeier and Texas Attorney General Ken Paxton brought this lawsuit to undo the FDA’s longstanding approval of mifepristone. If they succeed, all Americans stand to lose access to a drug that has been FDA-approved for more than 25 years and is now used in nearly two-thirds of abortions.
Florida v. FDA is one of three state lawsuits targeting mifepristone access. The Fifth Circuit will hear oral arguments in Louisiana v. FDA on September 9, and Missouri v. FDA remains pending. All three are playing out while Trump’s FDA runs a sham “review” of mifepristone, launched under mounting pressure from anti-abortion extremists. A district court judge in the Louisiana v. FDA case ordered the FDA to provide an update on its “review” by October 7. Heidi Overton, who has argued for remaking federal health agencies around Republicans’ anti-abortion agenda, would inherit the agency’s pursuit of a backdoor abortion ban should she be confirmed as FDA Commissioner.
