Reproductive Freedom for All Responds to Court Granting Trump Administration’s Request to Stall Louisiana v. FDA
Washington, DC — Today, a Trump-appointed judge on the United States District Court for the Western District of Louisiana granted the Trump administration’s request to pause Louisiana v. FDA—a case that seeks to enact sweeping nationwide restrictions on medication abortion by challenging an FDA determination allowing providers to safely prescribe mifepristone via telehealth.
While this decision does not alter access to mifepristone for now, it is not the end of the GOP’s attempts to make abortion care more difficult to access in all 50 states. Trump and his allies are continuing to rely on grossly flawed junk science to ram through restrictions that are unpopular with the majority of Americans: In January, Trump’s Department of Justice asked the court to halt Louisiana’s lawsuit while the FDA rushes through its politically motivated “review” of mifepristone, signaling that the agency could be poised to impose medically unnecessary restrictions and roll back medication abortion access on its own once its sham “review” is complete. Today’s court decision clears the way for that bogus process to continue without being immediately disrupted by any actions stemming from Louisiana’s baseless lawsuit. Several other cases aiming to limit access to medication abortion via telehealth are also still pending.

“More than two decades of overwhelming evidence prove that mifepristone is safe and effective. This lawsuit is baseless, and it shouldn’t be in court to begin with. The only reason this case exists—and the only reason Trump’s FDA is rushing a sham ‘review’—is to lay the groundwork to ban abortion nationwide.”
