Reproductive Freedom for All Responds to Supreme Court Extending Temporary Stay in Louisiana v. FDA
Washington, DC — Today, the U.S. Supreme Court extended its temporary stay in Louisiana v. FDA until 5pm EDT on Thursday, May 14, while the Court continues to review appeals. The stay blocks the Fifth Circuit’s ruling to revive medically unnecessary in-person dispensing requirements on mifepristone and restores access to the medication as it was prior to the Fifth Circuit’s ruling until then.
Reproductive Freedom for All President and CEO Mini Timmaraju released the following statement:
“Louisiana’s baseless case should not have gone to our nation’s highest court to begin with. It is a relief that access to mifepristone remains for now, but our work doesn’t end here. The Supreme Court must follow the law and uphold telehealth access to mifepristone. Decisions about abortion care belong to pregnant people and their health care providers—not lawmakers, not Donald Trump, and not the justices on the Supreme Court.”
Since the Supreme Court overturned Roe v. Wade, telehealth has been a lifeline for people in states with abortion bans, and for anyone who faces barriers to accessing in-person care, which disproportionately impact people living in rural areas, low-income communities, and communities of color. In states with abortion bans, average travel time to a clinic has already quadrupled—from under three hours to more than 11. In the first half of 2025, more than one in four abortions in the U.S. were provided via telemedicine using mifepristone.
