ICYMI: Mini Timmaraju Discusses Looming Louisiana v. FDA SCOTUS Decision with Ali Vitali
Today, Reproductive Freedom for All President and CEO Mini Timmaraju joined Way Too Early with Ali Vitali to discuss the Supreme Court’s looming decision in Louisiana v. FDA—the case threatening nationwide access to mifepristone, a safe and effective medication used in most U.S. abortion care as well as early miscarriage care. At stake is whether the FDA must reinstate a medically unnecessary in-person dispensing requirement. The Supreme Court must weigh in on the case before 5pm today, when its temporary stay on the Fifth Circuit’s original ruling will be lifted.
As Timmaraju and Vitali discussed this morning, the Supreme Court’s decision could leave access to mifepristone as it was before the Fifth Circuit’s ruling, or it could uphold the lower court’s ruling and eliminate telehealth access to mifepristone—effectively triggering a nationwide restriction on medication abortion. Timmaraju noted that the case bears similarities to Missouri v. FDA, another case that challenged mifepristone’s regulation in 2024 and was ultimately remanded to a lower court by SCOTUS.
This case is also pushing abortion rights back to the forefront of voters’ minds ahead of midterm elections—despite Trump and GOP efforts to sidestep the issue entirely. “I think this is a party that wants to do the bidding of its base, and will continue to do so, but is trying to do so in a way that doesn’t hurt their electoral chances,” Timmaraju said. Eight in 10 Americans support reproductive freedom and access to abortion. That’s why Republicans are trying to have it both ways—saying “leave it to the states” in public while Trump-appointed judges, anti-abortion extremists, and Project 2025 operatives push backdoor national abortion bans and restrictions through the courts. “They know they’re in a lot of trouble this fall. Our job is to not let them off the hook.”
Voters have consistently turned out for abortion access since Roe v. Wade was overturned in 2022, and Republican lawmakers know that the 2026 election cycle will be no different. Despite how unpopular these policies are, Republicans continue their relentless attacks on mifepristone through every channel to appease anti-abortion extremists—from Congress, to the courts, to federal agencies.
Trump and his allies know how politically toxic attempts to ban abortion are—they’re doing it anyway. To the politicians behind this extremist agenda: voters won’t forget who is responsible, and we will see you at the ballot box.
