Reproductive Freedom for All Slams Fifth Circuit Case That Threatens Mifepristone Access Nationwide Ahead of Oral Arguments
Washington, DC — Today, the U.S. Court of Appeals for the Fifth Circuit will hear oral arguments in Louisiana v. U.S. Food and Drug Administration (FDA), a lawsuit seeking to end mail and pharmacy access to mifepristone nationwide—including in states where abortion is protected.
The case seeks to impose an unnecessary requirement that patients obtain mifepristone in person, even though telehealth has been safely utilized for years. If successful, patients across the country could be forced to travel to a health center or hospital to pick up their medication, making abortion care far more difficult to obtain. This case marks the latest attack on abortion access and comes less than 60 days ahead of the midterm elections.
Reproductive Freedom for All President and CEO Mini Timmaraju released the following statement:
“Mifepristone is proven safe and effective, backed by decades of evidence. These attacks have nothing to do with science and everything to do with controlling our bodies and our futures.”
Access to mifepristone will not change immediately while the case proceeds. But if Louisiana succeeds, patients could be forced to travel—sometimes hundreds of miles—to pick up their medication in person, with especially harmful consequences for people in rural communities, low income people, and anyone who already faces barriers to care. The consequences on abortion access would be far-reaching: medication abortion accounts for two-thirds of abortions in the United States, and nearly 30% of abortion patients receive care through telehealth.
This case is one of three legal challenges threatening mifepristone access, all unfolding while the Trump administration’s FDA conducts a baseless “review” of the medication’s safety.
