Who is Anthony “Tony” Mattivi?

Mattivi has been an ardent supporter of anti-abortion efforts in Kansas. During his unsuccessful campaign for Kansas Attorney General in 2022, Mattivi pledged to personally defend a constitutional amendment that would have eliminated the right to abortion under the Kansas Constitution. Kansas voters later overwhelmingly rejected the amendment and the Kansas Supreme Court reaffirmed that the state’s constitution protects the right to abortion.

Mattivi also has a record of attacking other fundamental rights, including immigrant rights.

Quick Hits: Anthony Mattivi’s Record Against Reproductive Freedom

Mattivi is a long-time champion of the “Value Them Both Amendment,” an amendment that aims to enshrine that there is no constitutional right to abortion in Kansas, and has been recognized and commended by Kansans for Life.

Mattivi’s advocacy for an abortion ban in Kansas was in direct opposition to what Kansans really want. In 2022, 60% of Kansans voted against an amendment that would have affirmatively stated that there is no constitutional right to abortion. Confirming Mattivi as a federal judge for the United States District Court for the District of Kansas threatens access to reproductive freedom across the entire state.

Support for Anti-Abortion Constitutional Amendment

Mattivi built his unsuccessful 2022 Kansas Attorney General campaign in significant part around his pledge to personally defend a constitutional amendment that would have eliminated the right to abortion under the Kansas Constitution.

Connection to Kansans for Life

  • Mattivi was endorsed by Kansans for Life during his campaign for Kansas Attorney General and has publicly described himself as “pro-life.”
  • Mattivi doubled down on his anti-abortion views, expressing his disagreement with the Kansas Supreme Court’s 2019 ruling affirming the right to abortion.

Stigmatizing Reproductive Freedom Organizations

Mattivi repeatedly used inflammatory language to describe reproductive freedom nonprofit organizations across multiple public forums and campaign statements.

Tony Mattivi's Record Against Immigrant Rights

As KBI Director, Mattivi authorized the department’s cooperation with ICE through the 287(g) program, which allows state and local law enforcement agencies to enter agreements with the Department of Homeland Security (DHS) to perform certain immigration enforcement functions. This action effectively deputized local law enforcement to carry out duties typically reserved for federal immigration agents—raising significant concerns about civil liberties, racial profiling, and the erosion of trust between immigrant communities and law enforcement.

The Big Picture

Trump has a deeply troubling track record of nominating judges who oppose reproductive freedom, reflecting the Trump administration’s vision for courts that are hostile to the basic reproductive rights and freedoms of all Americans.

Decisions made by these judges will impact our health, access to care, and daily lives, and we deserve to know whether these nominees are committed to fairness and equality under the law or if they are beholden to an ideology or agenda opposing reproductive freedom.
