Attorney General Nominee Todd Blanche is a Threat to Reproductive Freedom

| Estimated reading time: 7 minutes | By: Reproductive Freedom for All

Trump's former personal attorney could use the Department of Justice to advance a dangerous anti-abortion agenda. Learn what's at stake—and how to take action.

Key Takeaways
  • Todd Blanche is Trump's nominee for Attorney General. Trump's former personal attorney now serves as Acting Attorney General–and has already used the Department of Justice to advance the administration's anti-abortion agenda.
  • The Attorney General has enormous power over reproductive freedom. The Department of Justice decides how federal laws are enforced, either defends or challenges abortion restrictions in court, protects (or refuses to protect) abortion providers and patients, and influences access to medication and emergency abortion care.

  • Blanche has already taken alarming actions. As Acting Attorney General, he fired the career prosecutors responsible for enforcing the FACE Act, and his department created a fund that would pay people convicted of blocking and harassing abortion clinics.
  • His confirmation could accelerate a national anti-abortion agenda. A Trump Justice Department led by Blanche could advance policies that restrict abortion access nationwide—without Congress ever passing a national abortion ban.

🔎 A Closer Look at Attorney General Nominee Todd Blanche

As Acting Attorney General, Blanche has already grossly misused his authority at the Department of Justice (DOJ) to serve Trump’s interests and an anti-abortion agenda.

Blanche fired career prosecutors who were responsible for enforcing the FACE Act, the law that protects patients and providers at abortion clinics.

On top of that, his department created a $1.8 billion fund to pay people who violated the FACE Act, including those convicted of harassment and violence towards clinics and patients (the fund drew sharp concern and has been blocked by a federal court).

🤿 Dive Into the Details of Todd Blanche’s Record

Todd Blanche is Trump’s former personal attorney and a proven Trump loyalist. Blanche represented Trump as his defense lawyer in the Stormy Daniels hush-money scandal–which ended in Trump’s conviction on 34 felony counts–and his federal election interference and classified documents cases.

Blanche has effectively shielded Trump, his family, and his businesses from federal investigations, blocking future audits of their past tax returns.

Blanche has demonstrated a willingness to prioritize loyalty to Trump over the DOJ’s independence. As Attorney General, Blanche would answer to Trump, not justice, and not to the American people.

Blanche’s Record on Dismantling Federal Protections for Reproductive Health Clinics

As Acting Attorney General, Blanche systematically dismantled the DOJ’s enforcement of the Freedom of Access to Clinic Entrances (FACE) Act, the federal law that makes it a crime to block, threaten, or use force against patients and staff at reproductive health clinics.

Blanches Record On Democracy and Voting Rights

As Acting Attorney General, Blanche has led the DOJ in dozens of unsuccessful lawsuits attempting to force states to turn over sensitive voter information, brokered a federal tax settlement in an attempt to shield President Trump and his family from future investigations, and publicly spread disinformation alleging that the 2020 election was rigged.

    • Under Blanche’s leadership, the DOJ filed 30 lawsuits against states and Washington, D.C. in an attempt to force them to turn over sensitive voter records. He falsely claimed the DOJ had the power to require that states remove flagged voters from their rolls, and sued states that refused to provide requested data. As of July 2026, courts have ruled against the DOJ in every case decided.
    • Civil rights groups filed their own lawsuits to stop the creation of a national voter database, until several judges ruled the department had acted illegally. Blanche continued his unlawful surveillance of voters by sending a federal prosecutor to watch ballots being counted during the Los Angeles runoff elections.
  • As recently as May 2026, Blanche claimed there was “a ton of evidence” that the 2020 election was rigged and said his top prosecutors were investigating election fraud in Georgia and Arizona. This contradicts his earlier sworn testimony to the Senate, where he acknowledged that Joe Biden won in 2020.
  • Blanche also created a special carve-out in a federal tax settlement that permanently bars the IRS from pursuing past tax returns of the president, his family, and their business associates.

⚠️  The Stakes for Reproductive Freedom: the Role of the Attorney General

The Attorney General leads the Department of Justice (DOJ) and plays a critical role in ensuring our most fundamental freedoms and rights are protected.

Following his nomination to this role, Blanche faced immediate calls from anti-abortion lawmakers and organizations to weaponize the DOJ. Extremists are urging him to change the DOJ’s litigation strategy in ongoing cases to help rescind or severely restrict federal approval of mifepristone—a safe, effective, and common medication used for abortion— nationwide.

As the nation’s chief law enforcement officer, the AG guides how federal laws are interpreted and enforced, including those related to reproductive freedom and critical civil rights laws.

The Attorney General has the power to devastate reproductive freedom in many ways including:

  • Leading and joining litigation efforts to restrict access to medication abortion and emergency abortion care
  • Halting investigations into violations of federal laws protecting abortion clinics from harassment—the Freedom of Access to Clinic Entrances Act (FACE Act)
  • Turning the DOJ into an instrument to monitor, track, and punish people for pregnancy outcomes–and/or to support, endorse or collaborate with anti-abortion states in punishing people for accessing or providing care
  • Misusing and weaponizing the Comstock Act to enact a de facto national abortion ban without ever requiring a vote from Congress

🛩️ The Big Picture

Trump has stacked his administration to the brim with extremists, and Todd Blanche is no exception. Just like his other nominees, Trump knows he can count on Blanche to carry out his extreme agenda without question.
