Attorney General Todd Blanche has pledged to use the Department of Justice to advance the Trump administration's anti-abortion agenda. Here's what's at stake and how to take action.
Blanche has said he will work "hand in hand" with other federal agencies to roll back abortion access nationwide. Now that the Senate has confirmed Blanche, the stakes are even higher. Hold your senators accountable for their vote and help us fight back against attacks on reproductive freedom.
Blanche now has enormous power to use the Department of Justice to continue advancing the Trump administration’s anti-abortion agenda.
And he’s already told us what that could look like.
In leaked audio, Blanche said the administration is working with the Department of Health and Human Services, the FDA, and the White House on “permanent solutions” to roll back abortion access nationwide. Dobbs was the Supreme Court decision that overturned Roe v. Wade, taking away our federal right to abortion. Blanche says they intend to make the Dobbs decision “permanent in every single state.”
One of the biggest threats is medication abortion access. Blanche has pledged that the DOJ will investigate potentially misusing the Comstock Act, an 1873 law to restrict mailing abortion pills nationwide. Mifepristone has a proven track record of safety and is the most common method of abortion.
As Acting Attorney General, Blanche grossly misused his authority at the Department of Justice (DOJ) to serve Trump’s interests and an anti-abortion agenda.
Todd Blanche is Trump’s former personal attorney and a proven Trump loyalist. Blanche represented Trump as his defense lawyer in the Stormy Daniels hush-money scandal—which ended in Trump’s conviction on 34 felony counts—and his federal election interference and classified documents cases.
Blanche has effectively shielded Trump, his family, and his businesses from federal investigations, blocking future audits of their past tax returns. He has demonstrated a willingness to prioritize loyalty to Trump over the DOJ’s independence and the rule of law. As Attorney General, Blanche would answer to Trump, not justice, and not to the American people.
Blanche fired career prosecutors who were responsible for enforcing the FACE Act, the law that protects patients and providers at abortion clinics.
On top of that, his department created a $1.8 billion fund to pay people who violated the FACE Act, including those convicted of harassment and violence towards clinics and patients (the fund drew sharp concern and has been blocked by a federal court).
As Acting Attorney General, Blanche systematically dismantled the DOJ’s enforcement of the Freedom of Access to Clinic Entrances (FACE) Act, the federal law that makes it a crime to block, threaten, or use force against patients and staff at reproductive health clinics.
As Acting Attorney General, Blanche has led the DOJ in dozens of unsuccessful lawsuits attempting to force states to turn over sensitive voter information, brokered a federal tax settlement in an attempt to shield President Trump and his family from future investigations, and publicly spread disinformation alleging that the 2020 election was rigged.
The Attorney General leads the Department of Justice (DOJ) and plays a critical role in ensuring our most fundamental freedoms and rights are protected.
Following his nomination to this role, Blanche faced immediate calls from anti-abortion lawmakers and organizations to weaponize the DOJ. Extremists are urging him to change the DOJ’s litigation strategy in ongoing cases to help rescind or severely restrict federal approval of mifepristone—a safe, effective, and common medication used for abortion— nationwide.
As the nation’s chief law enforcement officer, the AG guides how federal laws are interpreted and enforced, including those related to reproductive freedom and critical civil rights laws.
Todd Blanche is part of a broader effort to use the federal government to restrict reproductive freedom.
Trump has stacked his administration with anti-abortion extremists who have the power to shape access to reproductive health care through federal agencies, regulations, enforcement decisions, and the courts.
And the Senate plays a critical role in determining who gets that power.
Despite Blanche’s anti-abortion record and his stated willingness to target medication abortion, the Senate confirmed him to lead the Department of Justice.
That’s why accountability doesn’t end with a confirmation vote. We must elect reproductive freedom champions, and continue holding elected officials accountable for the decisions they make about our rights and freedoms.
