🔎A Closer Look: The Supreme Court Left Mifepristone Vulnerable to Attack


The Supreme Court left attacks on mifepristone open in its ruling on Alliance for Hippocratic Medicine v. FDA, a baseless case cooked up by anti-abortion extremist group AHM, a right-wing org that was whipped together specifically to ban medication abortion.

In its ruling in June 2024, the Supreme Court did not affirm the science or safety of mifepristone. Instead, SCOTUS dismissed the case saying that AHM could not show that anyone in that organization was personally harmed (a legal technicality called standing), essentially giving extremists the blueprint to try again.

This ruling left the door open for new lawsuits against mifepristone—which is exactly what Republican attorneys general and anti-abortion groups are now pursuing in lower courts in Missouri, Florida, and Louisiana.

These renewed cases aim to:

  • Ban mifepristone nationwide by revoking its FDA approval
  • Ban telehealth access to mifepristone
  • Reinstate outdated and medically unnecessary restrictions on mifepristone

  • Louisiana v. FDA is one of three federal cases brought by anti-abortion state officials seeking to block telehealth access to mifepristone.
  • Florida v. FDA seeks to further block mifepristone entirely by undoing its decades-old FDA approval.
  • Missouri v. FDA stems from the Alliance for Hippocratic Medicine v. FDA case heard by the Supreme Court that also seeks to block telehealth access and reinstate medically unnecessary restrictions on mifepristone.

Beyond these court cases, and despite two decades of scientific evidence for mifepristone’s safety and effectiveness, Republican lawmakers and anti-abortion groups have coordinated an all-out attack against mifepristone:

Junk science and disinformation

Anti-abortion extremist groups published a junk science “study” filled with anti-abortion lies that’s being weaponized by Republican lawmakers and the Trump administration to attack mifepristone. These groups have also been pushing absurd environmental claims about mifepristone.

FDA’s unnecessary, non-scientific “review” of mifepristone

Trump-appointed Health and Human Services (HHS) Secretary Robert F. Kennedy Jr. and Food and Drug Administration (FDA) Commissioner Martin Makary confirmed their sweeping “review” of mifepristone in a letter sent to Republican anti-abortion state attorneys general.

Republicans in Congress 
Misusing 1800s era Comstock Act 

In coordination with VP JD Vance, Congressional Republicans and extremists bringing baseless lawsuits are attempting to misuse a 150-year old law called the Comstock Act to block access to both abortion pills and medical equipment used for abortion care.

State-level attacks

Texas enacted one of the strictest medication abortion bans in the country, a bounty-hunter style law that allows anyone to sue providers, manufacturers, or distributors of medication abortion for $100,000.

Anti-abortion extremist groups disinformation and pressure campaigns

Anti-abortion groups publicly announced their intent to attack mifepristone which is playing out currently. Not only do these groups have deep ties to Congress, court cases, the FDA pressure campaign, they’re also aggressively pressuring businesses like Costco to block mifepristone from being dispensed in its pharmacies.

Abortion bans cause devastating harm. Banning or rolling back access to the most commonly used method of abortion can lead to a de facto nationwide ban—even in places where abortion is legally protected.

Anti-abortion extremists will not be satisfied until abortion is banned nationwide, providers and patients are punished, birth control is restricted, and fetuses and embryos are granted full legal rights as people.

By weaponizing the courts, anti-abortion extremists are attempting to override medical science, democratic will, and decades of safe use.
