Abandoning Emergency Abortion


The Emergency Medical Treatment and Labor Act (EMTALA) is a federal law that requires hospital emergency rooms to provide life-saving care, including abortion.

U.S. v. Idaho was a lawsuit brought by the Biden administration to ensure that hospitals in Idaho—where abortion is completely banned—must still comply with EMTALA and provide emergency abortion care. The lawsuit challenged Idaho’s abortion ban for violating federal law, arguing that hospitals cannot deny care to pregnant patients in crisis.

The case reached the Supreme Court where the conservative-majority refused to protect the life and health of pregnant people, leaving their rights uncertain while lower court rulings temporarily preserved emergency abortion access in Idaho.

And now, Trump’s Department of Justice under the leadership of anti-abortion extremist Pam Bondi, has decided to drop the case.

By abandoning this case, Trump’s DOJ is telling states with abortion bans that they don’t have to follow federal law, even if it means letting pregnant people suffer or die.

This isn’t just another legal maneuver—it’s part of conservatives’ bigger plan outlined in their extremist Project 2025 playbook to strip away reproductive rights nationwide. And if we don’t stop them, more people will be denied the care they need, with devastating consequences.

  • Shanae Smith-Cunningham needed an emergency abortion for a nonviable pregnancy — but Florida’s laws meant doctors couldn’t help her. They advised her to travel to New York for the care she needed. “They are playing with people’s lives with this law.”

She was forced to continue the pregnancy due to Tennessee’s abortion ban. “I was condemned to endure both physical and emotional torture, knowing that I was going to deliver a stillborn.
